Zweck
The competition concerns agreements on a duty to deliver newspapers by subscription to locations without other newspaper distribution, in accordance with the Law on Postal Services dated 4 September 2015 no. 91 ("The Post Act") §§ 6 and 7 other sections, cf. the regulations on post by 18 September 2015 no. 1063 ("The Postal Regulations") § 19. The service is characterised as a service of general economic importance. The procurement will be carried out in accordance with the EEA agreement ́s rules on public support and the so-called Altmark criteria. The Ministry of Transport ("the Contracting Authority") shall procure newspaper distribution on three scheduled weekdays (Tuesdays, Thursdays and Fridays). Such services shall be provided in the geographical area stated in the Requirement Specifications in Annexes 1.3 and 2.3 - Point 3 ("The Geographical Area"). The geographical area is divided into two delivery areas, delivery area B which makes up sub-contract 1 and delivery area C, which makes up sub-contract 2. Annex A makes up the total coverage area for sub-contracts 1 and 2. The Contracting Authority will, thus, enter into two total agreements. Tenderers can submit tenders for sub-contracts in both delivery areas, but there must be separate tender offers, cf. point 1.4 in the tender documentation.
Verfahren
The procurement will be carried out in accordance with the Act from 17 June 2016 no. 73 on public procurements (the Procurement Act) and regulations 12. August 2016 no. 975 on procurement regulations in the supply sectors (the utilities regulations) parts I and III, cf. the utilities regulations § 1-1, cf. § 1-8, cf. annex 3 Special Services and the CPV code 64111000 «Postal services connected with newspapers and periodicals», cf. § 5-1 third section. The procurement is published in Doffin and TED. The contracting authority plans to award contracts without having contact with the tenderers beyond making any minor clarifications of the tenders. Negotiations can, however, be carried out if the contracting authority deems it appropriate. The negotiations can apply to all sides of the tender and the negotiations can be held in several phases. The contracting authority emphasises that no tenderers can expect negotiations on their tender. The contracting authority encourages tenderers to follow the instructions given in this tender documentation with annexes and ask questions about uncertainties in the KGV.
